These Terms & Conditions (“Terms”) govern your access to and use of the SmartTender website, services, and all related content (collectively, the “Service”). By creating an account or otherwise accessing or using our Service, you agree to be bound by these Terms. If you do not agree to any part of these Terms, please discontinue using our Service immediately.

SmartTender provides AI-driven tender recommendations, alerts, and related content to help users identify and evaluate public tender opportunities in South Africa. We aggregate, filter, and analyze tender information from public sources and other relevant data providers.
2.2 No Guarantee of Results
While we strive to offer accurate and useful data, we do not guarantee that any particular tender will be suited to your needs or that you will be awarded any tender. Your use of the Service is at your own risk.
2.3 Not Financial or Legal Advice
Information provided by SmartTender is intended as a starting point for evaluating tender opportunities. It is not financial, legal, or business advice. Please consult professionals where necessary.
3. User Accounts
3.1 Account Creation
To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate and complete.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for any activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.
3.3 Termination or Suspension
We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms or engaged in any activity that may harm SmartTender or its users. You may also terminate your account at any time by contacting info@smarttender.co.za.
4. Subscription and Payment
4.1 Free Trial
We may offer a free trial for a specified period. After the free trial ends, you will need to subscribe to continue using the Service, unless you cancel before the trial period ends.
4.2 Subscription Plans
We offer various subscription plans at different pricing tiers. By selecting a paid subscription, you agree to pay all applicable fees in accordance with the terms displayed during checkout.
4.3 Payment Processing
We use third-party payment providers (e.g., Stripe) to process payments. You agree to abide by the terms and conditions of these payment providers. We do not store any credit card or payment information on our servers.
4.4 Cancellation
You can cancel your subscription at any time through your account settings or by contacting info@smarttender.co.za. Canceling a subscription will result in termination of the Service at the end of the current billing cycle, unless stated otherwise in specific promotional terms.
4.5 Refunds

5. User Obligations
5.1 Lawful Use
You agree to use the Service in a lawful manner and comply with all applicable local, provincial, and national laws of South Africa. You shall not use the Service to commit any unlawful act or infringe upon the rights of others.
5.2 Prohibited Conduct
You agree not to:

- Use the Service in any manner that could damage, disable, overburden, or impair our servers or networks.
- Attempt to gain unauthorized access to the Service or any user accounts through hacking or other means.
- Upload or transmit viruses or any other malicious code that may damage or disrupt the Service or its users.

6. Intellectual Property

8. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.2 Third-Party Content
We make no warranty regarding the accuracy, completeness, reliability, or availability of any third-party content or data accessed via the Service. We are not responsible for any errors or omissions in data provided by public tender platforms or other third parties.
9. Limitation of Liability
9.1 Indirect Damages
To the maximum extent permitted by law, SmartTender shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Service.
9.2 Maximum Liability
In no event shall SmartTender’s total liability to you for all claims exceed the amount you paid us (if any) for the Service in the six (6) months preceding the event that gave rise to the claim.
9.3 Consumer Protection
Nothing in these Terms shall be interpreted to limit or exclude any consumer protection rights you may have under South African law.
10. Indemnification
You agree to indemnify, defend, and hold harmless SmartTender, its directors, employees, affiliates, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any intellectual property or other rights of SmartTender or third parties.
11. Changes to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
